Abstract (En.): in the context of the health crisis management in France due to Covid-19, the Conseil d’état’s decision n. 440057, issued in order to promptly sanction the intervention of the mayor of a French commune, Sceaux, and the following decisions adopted by the judge of the référés, are particularly noteworthy. These measures mean a significant advance towards an increasingly detailed division of the municipalities’ room for manoeuvre in the time of public health crisis. Nevertheless, those decisions define, for the first time explicitly, the conditions that must be respected in order for local measures to be considered valid where the legislator has not yet intervened.
