Abstract (En.): the article deals with critical situations concerning the effectiveness of the right to health. Specifically, the particularly slow procedural process for updating essential health services (so-called “LEA”) results in great disparities in treatment among the weak. In this regard, the recent affair of the update of the decree determining the costs of essential services (so-called “decreto tariffe”) is examined: this is a paradigmatic case of the crisis of the healthcare system. In fact, the delay in the entry into force of this decree has led to a weakening of the minimum content of the right to health, due to budgetary requirements.
